BodyBlind – Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your access to and use of the BodyBlind mobile application and related services (collectively, the "Service"). The Service is operated by BodyBlind ("BodyBlind", "we", "us", or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Eligibility

You must be at least 16 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent and supervision of a parent or legal guardian.

You may use the Service only in jurisdictions where the app is lawfully available through the Apple App Store. By using the Service, you represent that you:

  • Are not prohibited from using the Service under applicable laws, and
  • Have provided truthful, accurate, and up-to-date registration information.

3. Description of the Service

BodyBlind is an AI-powered sports training and body analysis application. The Service includes, among other things:

  • Pose detection and body measurement calculation from photos and videos.
  • Personalized sports form analysis and guidance for golf, tennis, yoga, and pilates.
  • Progress tracking and analytics over time.
  • AI-generated feedback and AI-generated guide videos based on your body measurements.

The Service leverages Apple frameworks (e.g., Vision, SceneKit, HealthKit, StoreKit 2), Firebase (Authentication, Firestore, Storage, Cloud Functions, Analytics, Crashlytics), and third-party AI providers (such as Anthropic “Claude” and Google “Gemini”) through secure server-side calls.

The Service is provided for general informational and training purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. It does not replace professional coaching, medical, or physiotherapy advice. Always consult a qualified coach, trainer, or healthcare professional regarding your physical condition or training program.

4. Account Registration and Security

You may use the Service as a guest user (with data stored locally on your device) or as a registered user (with data stored in the cloud). When you create an account, we may use Firebase Authentication with Apple Sign-In, email/password, and/or anonymous sign-in that can later be upgraded.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized use of your account or any breach of security.

5. Subscriptions, Billing, and Free Tier

5.1 Free Tier

The Service offers a free tier that may include basic body analysis, limited history, one sport, and unlimited on-device 3D skeleton guides. The exact free features may change over time.

5.2 Premium Subscriptions

We offer auto-renewing paid subscriptions ("Premium") through Apple’s in-app purchase system (StoreKit 2), such as monthly and yearly plans. Premium may unlock, for example:

  • Video upload and detailed video analysis.
  • Access to all supported sports.
  • Advanced AI coaching and analysis features.
  • AI-generated guide videos with defined monthly limits.
  • Extended history and advanced analytics.

5.3 Auto-Renewal and Cancellation

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time in your Apple account settings.

5.4 Free Trials and Promotions

We may offer free trials or promotional pricing. Unless otherwise stated, free trials automatically convert to paid subscriptions at the end of the trial period unless you cancel before the trial ends.

5.5 Refunds

All billing and refunds for in-app purchases are handled by Apple under the App Store terms and policies. In most cases, we cannot issue refunds directly. You may contact Apple Support to request a refund where permitted by Apple and applicable law.

6. Acceptable Use

You agree that you will not:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Upload or transmit content that is defamatory, obscene, hateful, harassing, or infringes any intellectual property, privacy, or publicity rights of others.
  • Attempt to reverse engineer, decompile, or otherwise derive the source code of the app, backend, or third-party models.
  • Attempt to circumvent subscription, usage limits, or security controls.
  • Use the Service to create or train competing models or services without our prior written consent.

You are responsible for ensuring that any photos or videos you upload comply with these Terms and that you have obtained consent from any identifiable individuals appearing in your content.

7. User Content and License

"User Content" means any photos, videos, measurements, sport data, and other content you upload or generate through the Service. We do not operate a public social feed; User Content is used only for your personal analysis, for operating and improving the Service, and for internal analytics as described in the Privacy Policy.

Solely for the purpose of operating, maintaining, and improving the Service, you grant BodyBlind a non-exclusive, worldwide, royalty-free, revocable license to host, store, process, and display your User Content and to use derived data (such as pose data and anonymized analytics) to provide you with feedback and improve our algorithms. We do not sell your personal information or User Content.

8. Health, Safety, and AI Disclaimer

The Service provides sports technique guidance and analytics only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or injury. You are responsible for exercising safely and listening to your body. Always consult a qualified professional before starting or modifying an exercise program.

AI-generated content (including scores, feedback, and guide videos) may be incomplete or inaccurate and should be treated as general guidance, not as absolute truth. It should not replace professional judgment or common sense.

9. Intellectual Property

All intellectual property rights in and to the Service (excluding your User Content) are owned by BodyBlind and its licensors, including software, designs, UI components, text, graphics, logos, trademarks, prompts, and analysis logic.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, or create derivative works based on the Service, nor use any of our trademarks or branding without our prior written consent.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PARTICULAR LEVEL OF PERFORMANCE OR IMPROVEMENT WILL BE ACHIEVED.

YOU USE THE SERVICE AT YOUR OWN RISK, INCLUDING ANY PHYSICAL ACTIVITIES YOU CHOOSE TO PERFORM BASED ON OUR FEEDBACK OR CONTENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BODYBLIND AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN JURISDICTIONS WHERE LIMITATION OF LIABILITY IS RESTRICTED, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR, IF YOU HAVE NOT PAID, USD $50.

12. Indemnification

You agree to indemnify, defend, and hold harmless BodyBlind and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

To the extent permitted by mandatory local law, these Terms are governed by the laws of the jurisdiction in which BodyBlind is established, together with the laws of the jurisdiction where you reside (for example, the laws of your province in Canada or your state in the United States), without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent courts in a jurisdiction reasonably connected to you or to BodyBlind, except where consumer protection or privacy laws require a different forum.

14. Changes to the Service and to These Terms

We may modify or discontinue parts of the Service at any time. For ongoing subscriptions, we will not materially reduce core paid features during your current paid period without reasonable notice.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, where required by law, provide additional notice or seek your consent. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the changes.

15. Termination

You may stop using the Service at any time and may request deletion of your account through in-app controls (where available) or by contacting us. We may suspend or terminate your access to the Service or your account if you materially breach these Terms, if we are required to do so by law or by a platform provider, or if we discontinue the Service.
